Under the Americans with Disabilities Act, state and local governments, businesses, and nonprofit organizations that serve the public generally must allow service animals to accompany people with disabilities in all areas of the facility where the public is normally allowed to go. A restaurant owner in Ogden, Utah is refusing to allow customers with service dogs into his restaurant.

On two separate occasions, two customers who both require a service dog for their disabilities were told to leave Bombay Grill. One of the customers took cell phone video of the incident, in which the owner is heard telling him, “Sir. No dogs.”
Missy Warwood visited the restaurant with her husband and five-year-old son, Jefferson, who has Down’s syndrome and does not speak. His service dog, Sage, sat faithfully by the child’s side. Despite trying to educate the owner about the law, he replied, “No. It’s my opinion, it’s my restaurant. And I say, no dogs.”

After leaving the restaurant, Missy posted ADA regulations on Bombay Grill’s Facebook page. Two weeks later, a group of veterans visited the establishment and received the same treatment.
Abraham Swank’s service dog, Temperance, helps him with anxiety and mobility. He can’t leave the house without his faithful companion. He, too, was refused admittance to the restaurant. Another woman in the group, D. Berard, has a service dog to help with hearing issues. She and her dog were not allowed in either.

Fox 13 contacted the restaurant, and someone there told them they “do not allow dogs of any kind because they worry about if other customers are afraid of dogs.”
The owner reported that this restaurant is his responsibility, and he told Fox13 about a past incident where a dog attacked a customer.
